The Court of Appeal, Calabar Division presided over by Honourable Justice Monica Dongban-Mesem today in an unanimous decision set aside the Judgment of the National/State Assemblies Election Petition Tribunal which on the 11th November, 2011, validated the declaration of Honourable Mfawa Ofegobi as the winner of the election into the Yakurr One State Constituency of the Cross River State House of Assembly held on Saturday the 26th April, 2011. The Court of Appeal held that the Appellant, Otu Bassey Ukpenetu was not accorded the right of fair hearing by the National/State Assembly Election Petition Tribunal by rejecting the Statements on Oaths of witnesses called by the Appellant. The Court of Appeal accordingly ordered that the case should be transmitted back to be heard on the merit by another Election Tribunal afresh.
